Terms and Conditions of Parfinity GmbH

1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts between Parfinity GmbH, Dorfring 18c, 24235 Stein (hereinafter "Parfinity") and its customers (hereinafter "Customer") regarding the delivery of goods, in particular Parfinity boxes with fragrance samples and original perfumes. 1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. 1.3 Deviating, conflicting or supplementary General Terms and Conditions of the Customer shall only become part of the contract if Parfinity expressly agrees to their validity.

2.1 The product presentations in the online shop of Parfinity do not constitute a legally binding offer, but an invitation to the Customer to order goods.
2.2 By clicking the "Order with obligation to pay" button, the Customer submits a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order is sent immediately after sending the order by email. This order confirmation does not yet constitute acceptance of the contractual offer. 2.3 The contract is only concluded with the dispatch of an express order confirmation by email or with the dispatch of the goods.

3.1 Each Parfinity box contains 5 fragrance samples of the Customer's choice, each 2ml in high-quality glass vials, as well as an additional surprise sample (also 2ml). 3.2 The samples are filled from original testers of the respective brands. Parfinity is an authorized dealer of all brands offered in the shop. 3.3 The price of a Parfinity box is based on the total value of the included samples and starts at €50 plus any surcharges for particularly high-quality fragrances.

4.1 With each Parfinity box, the Customer receives a discount code in the amount of the purchase price of the respective box (excluding shipping costs). 4.2 The discount code can only be redeemed for the purchase of original perfumes with a minimum value of €90 in the Parfinity online shop. The discount code cannot be used for the purchase of additional Parfinity boxes. 4.3 Only one discount code can be redeemed per order. In the case of multiple Parfinity boxes, the Customer will receive corresponding multiple discount codes, which must be redeemed in separate orders. 4.4 The discount code is valid for 2 months from the date of the order of the Parfinity box. After this period, the claim expires without replacement. 4.5 The discount code is handwritten in the lid of the delivered Parfinity box. Upon request, the code can also be sent by email. 4.6 A cash payment of the discount value is excluded. The discount code is non-transferable.

5.1 All prices stated are final prices including the statutory value-added tax. 5.2 In addition to the stated prices, shipping costs may apply. The amount of the shipping costs will be displayed to the Customer before completing the order. Details on shipping costs can be found at www.parfinity.com/shipping. 5.3 Payment can be made by prepayment (bank transfer), credit card, PayPal, or on account. In the case of payment by prepayment, dispatch will take place after receipt of payment.

6.1 Delivery will be made to the delivery address specified by the Customer within Germany and to the countries specified by Parfinity. 6.2 The delivery time is 2-3 working days for payment by credit card, PayPal, or on account, or 2-3 working days after receipt of payment for prepayment, unless otherwise stated for the item. 6.3 If a desired fragrance sample in the Parfinity box is not available at short notice, Parfinity reserves the right to deliver an equivalent alternative after consultation with the Customer or to refund the purchase price proportionally.

7.1 Consumers generally have a statutory right of withdrawal. 7.2 The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
7.3 No right of withdrawal for fragrance samples: Parfinity boxes and individual fragrance samples are excluded from the right of withdrawal, as they are sealed cosmetics that cannot be returned for hygienic reasons after the seal has been opened (§ 312g Abs. 2 Nr. 3 BGB). 7.4 The statutory right of withdrawal applies to unopened original perfumes.

8.1 The statutory warranty rights apply. 8.2 The Customer is informed that perfumes may contain alcohol and allergy-causing fragrance substances. Liability for allergic reactions or intolerances is excluded, unless they are based on a defect in the goods. 8.3 Parfinity is liable without limitation for damages resulting from injury to life, body, or health that are based on an intentional or negligent breach of duty, as well as for other damages that are based on an intentional or grossly negligent breach of duty or deceit. 8.4 In the case of slightly negligent breaches of duty, Parfinity's liability is limited to the foreseeable, contract-typical, direct average damage.

9.1 The sale of perfumes is only permitted to persons who have reached the age of 16, as perfumes contain alcohol.

10.1 Parfinity collects and processes the personal data of the Customer within the framework of the contract processing. Details can be found in Parfinity's privacy policy at www.parfinity.com/privacy.

11.1 The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. Parfinity's email address is: info@parfinity.com 11.2 Parfinity is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. 12.2 If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Kiel. The same applies if the Customer has no general place of jurisdiction in Germany or if their residence or habitual abode is unknown at the time of filing the lawsuit. 12.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
